Terms of Service

These Terms of Service ("Terms") govern your access to and use of Hoops Heroes (the "Game"), including the iOS app, the web game at play.hoops-heroes.com, related websites, and any optional account, cloud save, leaderboard, or purchase features we provide (collectively, the "Service").

The Service is operated by Forte Apps LLC ("Forte Apps," "we," "us," or "our"). By downloading, installing, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be able to form a binding contract in your place of residence to use paid features of the Service. If you are under the age of majority where you live, you may use the Service only with permission and supervision of a parent or legal guardian who accepts these Terms on your behalf.

The Game is intended for a general audience. We do not knowingly offer accounts or collect personal information from children under 13 without appropriate consent. See our Privacy Policy.

2. The Service

Hoops Heroes is a basketball survival game. Core gameplay may work offline on supported devices. Some features — including optional account login, cloud save, leaderboards, and purchases — require an internet connection.

We may update, change, suspend, or discontinue any part of the Service at any time, including game balance, virtual items, pricing, features, or availability by platform or region.

3. Accounts

Creating an account is optional. If you create one, you are responsible for keeping your login credentials confidential and for activity under your account. Notify us through the support request form if you believe your account has been compromised.

You agree to provide accurate information and not to impersonate others or create accounts through unauthorized automated means.

4. License

Subject to these Terms, Forte Apps grants you a personal, limited, non-exclusive, non-transferable, revocable license to access and use the Service for your own non-commercial entertainment. You may not copy, modify, reverse engineer, decompile, distribute, sell, rent, sublicense, or create derivative works from the Service except where applicable law expressly allows.

5. Virtual items and currency

The Game may include virtual currency (such as Gems and Gold), items, gear, passes, boosts, and other digital content ("Virtual Items"). Virtual Items have no real-world monetary value, are not legal tender, are not redeemable for cash, and are licensed — not sold — to you for use only within the Game.

6. Purchases and billing

Optional paid content is available through in-app purchases and subscriptions. Prices, taxes, and available packs are shown at checkout and may vary by platform, currency, or region.

6.1 iPhone / App Store purchases

Purchases made in the iOS app are processed by Apple through the App Store. Apple is the merchant of record for those transactions. Your purchase is also subject to Apple's applicable terms and policies, including Apple Media Services Terms and the Licensed Application End User License Agreement where applicable.

We use RevenueCat and Apple StoreKit to validate purchases and deliver entitlements in the Game. Receipt validation and subscription status may be handled by those services on our behalf.

6.2 Web purchases

Purchases made on the web game at play.hoops-heroes.com are processed through RevenueCat Web Billing with Stripe as the payment processor. For those transactions, Forte Apps is the seller of record unless otherwise stated at checkout. Your payment card and billing details are handled by Stripe according to Stripe's terms and privacy practices.

6.3 Gem Bags (consumables)

Gem Bags are consumable purchases that credit Gems to your in-game wallet. Current packs include Small Gem Bag (100 Gems), Gem Bag (550 Gems), Large Gem Bag (1,200 Gems), and Mega Gem Bag (2,500 Gems). Exact totals, bonus Gems, and prices are shown in the Shop before you confirm payment. Active Season Pass members may receive additional bonus Gems on Gem Bag purchases as described in the Shop.

Because Gem Bags are consumed immediately upon delivery, all Gem Bag sales are final except where required by law or the applicable platform's policies.

6.4 Season Pass subscriptions

Season Pass is an auto-renewing monthly subscription with tiered benefits. Current tiers are Lower Section, Box Seat, and Courtside. Benefits may include signup Gems, recurring monthly Gems, member bonus value on Gem Bags, and monthly Locker rewards while your subscription is active. Exact benefits for each tier are shown in the Shop before purchase.

6.5 Restore purchases

On iPhone, use the in-game restore option where provided so previously purchased non-consumable entitlements and active subscriptions can be re-synced to your account or device through Apple and RevenueCat.

6.6 Authorization

By completing a purchase, you authorize the applicable payment processor to charge your selected payment method for the displayed price, applicable taxes, and recurring subscription renewals until you cancel.

7. Refunds

Except where required by law:

For billing help, submit a support request and include your platform (iPhone or web), approximate purchase time, and the email tied to your account or receipt.

You agree not to:

We may investigate violations and suspend or terminate access, remove content, revoke Virtual Items, or restrict leaderboard participation.

9. User content

If the Service lets you submit a display name, scores, or other content, you retain any rights you already hold in that content. You grant Forte Apps a worldwide, royalty-free license to host, display, reproduce, and use that content solely to operate and promote the Service. You represent that your content does not violate law or third-party rights.

10. Intellectual property

The Service, including software, art, audio, trademarks, logos, and game design, is owned by Forte Apps or its licensors and protected by intellectual property laws. No rights are granted except the limited license in Section 4.

11. Third-party services

The Service relies on third parties such as Apple, RevenueCat, Stripe, and hosting providers. Their services are subject to their own terms and policies. We are not responsible for third-party services outside our reasonable control.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, FORTE APPS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE UNINTERRUPTED, ERROR-FREE, OR SECURE OPERATION, OR THAT PROGRESS, VIRTUAL ITEMS, OR PURCHASES WILL ALWAYS REMAIN AVAILABLE.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FORTE APPS AND ITS OFFICERS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR VIRTUAL ITEMS, ARISING FROM YOUR USE OF THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO FORTE APPS FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $50.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

14. Indemnification

You agree to defend, indemnify, and hold harmless Forte Apps from claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your misuse of the Service, your content, or your violation of these Terms or applicable law.

15. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Sections that by nature should survive termination — including payment obligations already incurred, intellectual property, disclaimers, limitations of liability, and dispute terms — will survive.

16. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will post the updated Terms on this page and update the "Last updated" date. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

17. Governing law

These Terms are governed by the laws of the United States and the State of Texas, without regard to conflict-of-law rules, except where mandatory consumer protection laws in your country of residence require otherwise.

18. Binding arbitration

Please read this section carefully. It affects your legal rights.

Except for the exclusions below, you and Forte Apps agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service (a "Dispute") will be resolved by binding individual arbitration, not in court, and not as a class, collective, or representative action.

18.1 Informal resolution first

Before starting arbitration, you agree to submit a support request with a short description of the Dispute and your requested resolution. If we cannot resolve the Dispute within thirty (30) days, either party may proceed to arbitration.

18.2 Arbitration rules and administrator

Arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect. If the AAA is unavailable, the parties will select another nationally recognized arbitration provider with substantially similar consumer rules. The AAA rules are available at adr.org.

18.3 Location and process

Unless you and Forte Apps agree otherwise, arbitration will take place in Texas, or by video/telephone if the arbitrator allows. The arbitrator may award the same individual relief a court could award, subject to these Terms.

18.4 Fees

Payment of filing, administration, and arbitrator fees will be governed by the AAA rules. If those rules require Forte Apps to pay fees that would make arbitration prohibitively expensive compared with court, Forte Apps will pay whatever is necessary so arbitration remains available on an individual basis.

18.5 Class action waiver

You and Forte Apps agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims or preside over any form of class or representative proceeding.

18.6 Exclusions

Either party may:

If a court finds any part of this arbitration section unenforceable as to a particular claim, that claim may proceed in court and the rest of this section will still apply.

18.7 Opt-out

You may opt out of this arbitration agreement within thirty (30) days of first accepting these Terms by submitting a support request with subject line "Arbitration Opt-Out" and your account email (if any). If you opt out, the rest of these Terms still apply and Disputes will be resolved in the state or federal courts located in Texas.
